Privacy Policy

nudge LLC ("nudge", "Nudge," "we," "us," or "our") operates the Nudge mobile application (the "App"). This Privacy Policy explains what information we collect, how we use it, who we share it with, and your rights regarding your data.

By using the App, you agree to the collection and use of information as described in this policy. If you do not agree, please do not use the App.


1. Information We Collect

Account Information

When you create an account, we receive the information provided by your sign-in method (Apple, Google, or email/password). This typically includes your name and email address. We do not store your authentication passwords; authentication is handled by a third-party authentication service.

Reminder and Task Data

When you create reminders or tasks, we store that data (description, scheduled time, status) so the App can function.

Device and Usage Information

We collect push notification tokens, basic device information (operating system, app version), and crash/diagnostic data to maintain and improve the App.


2. How We Use Your Information

  • To provide and operate the App, including reminders and check-ins
  • To authenticate your account
  • To send you push notifications for scheduled reminders and calls
  • To improve the App's performance, reliability, and features
  • To respond to support requests

3. Third-Party Services

We use the following third-party services to operate the App. Your data is shared with these providers only as necessary to deliver the App's functionality. All third-party providers are required to protect your data to the same or equivalent standard described in this policy.

  • AI processing (Anthropic): Conversation data is sent to Anthropic to generate responses. Anthropic does not use API data to train its models. See Anthropic's privacy policy.
  • Speech processing (Cartesia): Cartesia provides voice processing capabilities. We have opted out of Cartesia using your data to improve their products.
  • Infrastructure providers: We use third-party services for real-time communication, account authentication, and push notifications.
  • Sign-in providers: If you sign in with Apple or Google, we receive limited profile information (name, email) as authorized by you. We do not receive or store your Apple or Google account password.

None of our third-party service providers use your data to train AI models. Each provider's handling of data is governed by their own privacy policies.


4. Microphone Usage

Nudge requests access to your device's microphone solely for voice conversations. The microphone is only active during a conversation session and is never accessed in the background. You can revoke microphone access at any time in your device settings.


5. Data Retention

  • Account information: retained for as long as your account exists; deleted within 30 days of account deletion
  • Reminder and task data: retained for as long as your account exists, or until you delete individual reminders; deleted within 30 days of account deletion
  • Push notification tokens: retained while your account is active; removed on account deletion
  • Third-party retention: subject to each provider's own retention policies

6. Beta Program

Nudge is currently in beta. During this period, we may collect additional data, including conversation transcripts, to evaluate and improve the service. This data is used solely to improve Nudge. It is never shared publicly or sold.

Beta testers will be notified of any material changes to data collection practices. If you do not wish to participate under these terms, you may stop using the App and request deletion of your data at any time.


7. Data Security

We use industry-standard security measures to protect your data, including encryption in transit and at rest. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.


8. Your Rights

Depending on your location, you may have the following rights:

  • Access: request a copy of the personal data we hold about you
  • Deletion: request that we delete your account and associated data
  • Correction: request correction of inaccurate personal data
  • Portability: request your data in a portable format
  • Opt-out: you can stop using the App at any time

Account Deletion

You can delete your account directly within the App. When you delete your account, we will delete your account information, reminder data, and push notification tokens from our systems. Please note that data previously transmitted to third-party services during normal use of the App (such as conversation data processed by our service providers) may be retained by those services for a limited period in accordance with their own privacy and data retention policies.


9. California Privacy Rights (CCPA)

If you are a California resident, you have the right to:

  • Know what personal information we collect and how it is used
  • Request deletion of your personal information
  • Request correction of inaccurate personal information
  • Not be discriminated against for exercising your privacy rights

Categories of Personal Information Collected

Under the CCPA, we collect the following categories:

  • Identifiers: name, email address, account ID, device identifiers, push notification tokens
  • Sensory information: voice data processed in real time during conversations (not stored)
  • Internet or electronic network activity: app usage data, crash/diagnostic data

We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising.


10. European Privacy Rights (GDPR)

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have additional rights under the General Data Protection Regulation (GDPR):

Legal Basis for Processing

  • Contract: processing your account data and reminders is necessary to provide the service you signed up for
  • Consent: before your data is sent to third-party AI services, we obtain your explicit consent through an in-app disclosure
  • Legitimate interest: crash/diagnostic data and service improvements, balanced against your privacy rights

International Data Transfers

Your data is processed in the United States. Where required, we rely on Standard Contractual Clauses (SCCs) or other approved transfer mechanisms to safeguard your data during international transfers.

Your Additional Rights

  • Right to object: you may object to processing based on legitimate interests by contacting us
  • Right to withdraw consent: you may withdraw your consent to AI data processing at any time by contacting us or deleting your account
  • Supervisory authority: you have the right to lodge a complaint with your local data protection authority

11. Children's Privacy

Nudge is intended for users aged 18 and older. We do not knowingly collect personal information from anyone under 18. If you believe someone under 18 has provided us with personal information, please contact us and we will delete it.


12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy in the App or on our website, with the updated "Last updated" date at the top. Your continued use of the App after changes are posted constitutes your acceptance of the updated policy.
